These Terms of Service ("Terms") govern your access to and use of Kamu, operated by [COMPANY LEGAL NAME] ("Kamu", "we", "us"). By creating an account or using the service, you agree to these Terms.
1. The service
Kamu is an autonomous growth operator: an AI agent that researches your market and, within limits you configure, performs growth work on your behalf — including finding prospects, drafting and sending outreach email, publishing social posts, and drafting content. You direct and supervise this work; Kamu acts as a tool operating under your instructions and your accounts.
2. Your account
You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 and able to form a binding contract. You are responsible for the acts of anyone you allow to use your account.
3. You are the sender and controller
For any outreach Kamu performs for you, you are the sender and the data controller. You represent that you have a lawful basis to contact each recipient and to process their data, and that your use complies with all applicable laws — including the CAN-SPAM Act, CASL, GDPR, and PECR — and with our Acceptable use & anti-spam policy, which is incorporated into these Terms. You are responsible for the content and consequences of messages sent from your connected accounts and domains.
4. AI-generated output
Kamu uses large language models to generate research, messages, and content. Output may be inaccurate, incomplete, or unsuitable, and is not professional advice. You are responsible for reviewing output before it is relied upon or sent. We provide the service on a best-efforts basis and do not warrant any particular result (e.g. replies, meetings, or revenue).
5. Plans, billing, and cancellation
Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Fees are stated at checkout and are exclusive of taxes unless noted. Plans include usage limits (such as daily send caps and a monthly AI-work budget); we may pace or pause work to stay within them. You can cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. We may change pricing on renewal with reasonable notice.
6. Acceptable use
You must not misuse the service. Prohibited conduct is described in our Acceptable use & anti-spam policy. We may suspend or terminate accounts that violate it, that create deliverability or legal risk, or that fail to pay.
7. Intellectual property
We retain all rights in the service. You retain rights in your own content and data. You grant us a limited license to process your content and data solely to provide and improve the service. Subject to your paid plan, output generated for you is yours to use.
8. Termination
You may stop using the service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law. On termination we will delete or return your data as described in our Privacy policy and, where applicable, our Data processing addendum.
9. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any growth outcome will be achieved.
10. Limitation of liability
To the maximum extent permitted by law, Kamu and [COMPANY LEGAL NAME] will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim will not exceed the amounts you paid us in the 12 months before the event giving rise to the claim.
11. Indemnification
You will indemnify and hold harmless Kamu and [COMPANY LEGAL NAME] from claims arising out of your content, your outreach, your use of the service, or your violation of these Terms or applicable law.
12. Governing law
These Terms are governed by the laws of [GOVERNING-LAW JURISDICTION], without regard to conflict-of-laws rules. The courts located in [GOVERNING-LAW JURISDICTION] will have exclusive jurisdiction, except where applicable law provides otherwise.
13. Changes
